The Government of India has established the Data Protection Board
of India (DPBI) under Section 18 of the Digital Personal Data
Protection Act, 2023. The Board has been established as a body
corporate with the mandate to function as an independent
adjudicatory authority for the effective enforcement of the
provisions of the Act. The DPBI is envisaged as a digital-by-design
institution, aligned with the Government’s objective of ensuring
efficient, transparent, and technology-enabled governance. It is
empowered to inquire into personal data breaches and instances of
non-compliance, issue appropriate directions for mitigation and
remediation, and impose monetary penalties, in accordance with the
provisions of the DPDP Act and the DPDP Rules 2025 framed
thereunder.
The Board consists of a Chairperson and four other Members.
