3. Nature of Legal & Technical Information

India’s Digital Personal Data Protection Act, 2023 (Act No. 22 of 2023), the subordinate DPDP Rules, 2025, and related gazetted commencement orders (such as G.S.R. 843(E) and G.S.R. 846(E)) are evolving statutory instruments. The statutory interpretations and architectural methodologies presented on this portal reflect our research baseline as of 15 September 2026 and the December 2025 MeitY Corrigendum.

Please be advised of the following critical operational realities:

  • Regulatory Discretion: Determinations regarding Significant Data Fiduciary (SDF) designation under Section 10, adequacy of reasonable security safeguards under Section 8(5), and mitigation calculations under Section 33(2) remain within the exclusive adjudicatory jurisdiction of the Data Protection Board of India (DPBI) and the Central Government.

  • No Implied Warranty: Dhristhi does not warrant that compliance with any checklist or control matrix published herein guarantees total legal immunity or complete regulatory acceptance during a statutory inquiry.

4. Intellectual Property & Usage License

All original text, structural taxonomies, control mappings, state machine diagrams, interactive software code, UI designs, and product specifications published on this portal are the exclusive intellectual property of Dhristhi System Pvt. Ltd., protected under Indian and international copyright and trademark laws.

🚫 Prohibited Activities:

  • Any statutory fines or administrative penalties imposed under the DPDP Act 2023 (including Section 33 Schedule ceilings up to ₹250 crore);
  • Loss of profits, loss of data, loss of business goodwill, or commercial disruption;
  • Damages resulting from security breaches, ransomware, data leaks, or unauthorized processor disclosures;
  • Any inaccuracies, omissions, errors, or delays in the regulatory interpretations or statutory crosswalks provided on this site.

7. Governing Law & Dispute Resolution

These Terms and Conditions shall be governed by, construed, and enforced in accordance with the substantive laws of the Republic of India, without regard to its conflict of law principles.

Any dispute, controversy, or claim arising out of or relating to these Terms or the use of this portal shall be subject to the exclusive jurisdiction of the competent courts situated in Bengaluru, Karnataka, India.
